Terms of Service

These Terms of Service (the "Terms") govern your access to and use of PostBakery (the "Service"), operated by [Company Name] EOOD, a company registered in the Republic of Bulgaria (UIC / ЕИК: [Registration No.]) ("PostBakery", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PostBakery is an AI tool that generates Instagram and Facebook post images and captions matched to your brand, and — if you connect your accounts — lets you publish them to Facebook and Instagram. We may add, change, or remove features over time.

2. Eligibility and accounts

You must be at least 16 years old and able to enter into a binding contract. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity that occurs under your account.

3. Acceptable use

You agree not to use the Service to:

  • Generate or publish content that is unlawful, infringing, deceptive, hateful, harassing, or otherwise harmful.
  • Violate the terms, policies, or community standards of Meta, Instagram, or any other connected platform.
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure.
  • Circumvent usage quotas, rate limits, or other technical restrictions.

4. AI-generated content

The Service uses third-party AI models to generate images and captions from your inputs. As between you and PostBakery, you own the inputs you provide and the outputs generated for you, to the extent permitted by law. You are solely responsible for reviewing generated content before publishing it and for ensuring it is accurate, lawful, and appropriate for your audience. AI output may be inaccurate or may unintentionally resemble existing works; we make no warranty that output is original or non-infringing.

5. Connecting and publishing to social accounts

When you connect a Facebook Page or Instagram Business account, you authorize PostBakery to publish the content you create and approve to those accounts on your behalf. You confirm that you have the right to manage and publish to those accounts. Your use of Facebook and Instagram remains subject to Meta's own terms and policies, and you are responsible for complying with them. You can disconnect an account at any time.

6. Plans, billing, and cancellation

The Service offers a free tier and paid subscription plans. Paid plans are billed in advance through Stripe on a recurring basis until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and we do not provide pro-rated refunds except where required by law. Usage quotas apply per plan as described on our pricing page.

7. Intellectual property

The Service itself — including its software, design, and trademarks (including the PostBakery name and logo) — is owned by PostBakery and protected by intellectual-property laws. These Terms do not grant you any right to use our branding without prior written permission.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your requirements.

9. Limitation of liability

To the maximum extent permitted by law, PostBakery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Service shall not exceed the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or fifty euros (€50). Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold PostBakery harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms or of any third-party rights or platform policies.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us, other users, or third parties.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Bulgaria, without regard to conflict-of-laws rules. The competent courts of Bulgaria shall have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
